How to Convert Legal Separation to Divorce in Washington State

    • 1). Wait the legally required amount of time. In the state of Washington, you must wait six months after legally filing for separation before you can ask the courts to convert the separation into a divorce.

    • 2). Talk to your spouse to let him know of your plans. If he agrees, the process will be quick.

    • 3). File a "Motion and Declaration to Convert Decree of Legal Separation to Decree of Dissolution" at your local county family court. This motion is available for download at the Washington State Courts website. A courthouse facilitator at the family courthouse also will be able to provide you with a copy of the form if you are unable to get one online. After you file the motion, the clerk will give you a hearing date.

    • 4). Deliver a copy of motion and the upcoming hearing date to your spouse.

    • 5). Appear at the hearing. If neither party is contesting, the divorce will likely be finalized during that time. If there are any other problems, the court will schedule future hearings.
