How to Make Changes to Your Revocable Trust
One of the benefits of using a Revocable Living Trust as the foundation of your estate plan is that it gives you the flexibility to make changes to the terms of the trust agreement or completely revoke the trust at any time while you are competent to make changes. But how do you make changes to your trust that will be legally valid?
Trust Amendments and Restatements
In order to make changes to your Revocable Living Trust, you can do any of the following:
- Sign a Trust Amendment that is valid under your applicable state law.
- Sign a complete Trust Restatement that is valid under your applicable state law.
- Sign a complete revocation of the original trust agreement and any amendments, transfer the assets held in the revoked trust back into your individual name, and then create and fund a brand new Revocable Living Trust.
