• Copyrights are technically used to protect the authors of original works. Trademarks are words, names, symbols or devices that are used to distinguish goods from other goods. You can trademark a term that's used as a product or business name.
  
  

Initial Trademarking

• Anything you create is technically trademarked the moment you create it. If some dispute arises, you must prove that you created the term. This is often difficult to do without a registered trademark.
  
  

Acquiring an Official Trademark

• Official trademark forms can be found at the United States Patent and Trademark Office website. Once you fill out and send in this form, your term will be in line to be trademarked.
