The H1-B Visa is needed for employment based or temporary workers that are not immigrants.
Not only must the employer offer a job but they must also apply for the H1-B visa that must be registered with the U.
S.
Immigration Department.
In order for the H1-B Visa to be legal it will need to be approved once petitioned so the individual will be allowed to obtain a visa stamp and go to work.
You may need to have representation during this time in order to process all the paperwork correctly and to make sure that you don't forget anything.
One mistake and it may cost you and you will need to return back to your home country.
However if you follow the procedures correctly then you shouldn't have any problem.
The total number of H1B Visa's issued is on the rise.
More visitors wish to stay in the U.
S.
and work and there are a few perks for business owners who hire immigrants to work for them.
Once an H1-B Visa has been issued, you will be able to stay for an initial period of three years and that can be extended up to a period of six years as long as there are no problems.
You will need to get your H1B Visa re-stamped once you have been approved for an extension.
Having only a letter of acknowledgement is not good enough.
It will be your responsibility to always make sure that your paperwork is in order so you don't get forced back out of the country.
The H1-B Visa can also allow you permission to travel in and out of the country for no certain amount of times.
That means that if you have a permanent residence in your home country you may come here to work and go back home when needed.
When your H1-B Visa is renewed so is the unlimited travel.
You can travel weekly, monthly, or yearly and never need to apply for any additional paperwork.
You can only find employment with U.
S.
employers who have petitioned to employ H1B aliens.
Without the petition, the U.
S.
employer will not be able to legally hire you unless you have received your permanent status.
While working, you will qualify for vacations, sick leave, maternity leave, or strike without losing your rights to stay in the U.
S.
as long as you don't quit working for this employer.
As long as you are employed and hold an H1-B Visa, your family will be able to stay as well.
Family includes your spouse and any unmarried child living with you under the age of 21.
If you do decide to change employers you will need to find an H1B petitioned employer in order for your H1-B Visa to transfer over to the new employer.
However, this process can take time and while you are transferring you may need to stay with your current employer so you don't take the chance of losing your job completely and going without pay.
You will not qualify for temporary benefits from the state in which you reside so you need to make sure you are able to take care of yourself and your family.
