How to Protect the Whistleblower

    • 1). Contact your local Occupational Safety and Health Administration office if you believe that your employer is discriminating against you due to the fact that you have filed a whistleblower action. Note that there is a small time window in this regard; you have 30 days to report the discrimination.

    • 2). Draft an OSHA 11(c) complaint. Depending upon the nature and type of whistleblower case you have filed, you may need to file a written complaint. Lay out the basic elements of the discrimination you are experiencing in your complaint. Mail this via certified mail to your local OSHA office.

    • 3). Meet with OSHA officials to review your claim. After you file your complaint, your local OSHA office will review the complaint and assign an investigator to handle the matter. If OSHA makes a determination that your claim is valid, it will ask the employer to restore you to your original position and benefits. If the employer refuses to do so, OSHA may file suit or enter into mediation with the employer to resolve the issue.
