Louisiana lemon laws cover all passenger motor and passenger/ commercial vehicles not exceeding 10,000 pounds and are purchased or leased within the state. It also protects chassis and drive train of motor homes, watercrafts and all- terrain vehicles that are used exclusively for personal pleasure provided that products are sold within the state and are still under warranty.

Louisiana Lemon Laws Qualifying Factors

To qualify under the Louisiana laws protection, the vehicle must have suffered the same defect which has not been fixed after four repair attempts. The vehicle must have been out of service for at least 90 cumulative days during the protection period. Moreover, the defect should be serious enough to deteriorate the vehicle's market value and by which defect is a threat to the safety of the owner/passengers.

Louisiana Lemon Laws Protection Period

Protection period refers to the warranty period provided by the manufacturer or within 12 months from purchase (delivery of the vehicle), whichever comes first. When the car problem occurs within the protection period, complainant will be covered by legality of complaint. Arbitration process or out of court settlement is also required. However, the complainant can always approach the court for proper litigation if he finds the decision of the arbitrator unsatisfactory.

Under Louisiana laws, the manufacturer shall be notified in writing regarding the defect/s of the vehicle. The manufacturer shall be given the chance to repair the nonconformities. While still under warranty and under repair, the car owner can have the option of renting another vehicle by which the manufacturer is obliged to reimburse the expenses up to $20 per day.
