Rules for Overstaying in India on a Visa
- If you are in India and have overstayed your visa or want to file a visa extension, you must visit the Foreign Regional Registration Office (FRRO). Upon entry into India, you should have registered with the FRRO (within 14 days of entry). If you did not and you have overshot your visa, report to the office immediately. Offices are located in New Delhi, Mumbai, Kolkata and Amritsar. In other regions, contact the Superintendents Police (SP) for registration.
- You can receive a 15-day extension from the FRRO for immediate reasons of illness, death or flight problem.
- A one-month extension can be granted for serious illness, death, marriage or travel disruption.
- A three-month extension can be granted concerning issues of work or study. These cases are not handled by the FRRO but by the Ministry of Home Affairs.
- One-year extensions are usually only granted to spouses of Indian citizens on a year-to-year basis and will be handled by the Ministry of Home Affairs.
- Five-year extensions can be granted to foreigners of Indian descent, spouses or children of Indian citizens on short-term or in-between visa processes, and children younger than 16 years old.
