Everything you do when preparing your defense for a contempt for nonpayment defense needs to be documented.
You not only need to have your facts straight, as stated in in previous articles on contempt of court, but it needs to be written down.
Your argument that you are not willfully non-compliant, even though it needs to be expressed verbally, also needs to be written down.
Everything should always be in writing.
There are several reasons for this.
One of the best reasons for having everything written down is you stay on track.
You are less like to lose your focus, or forget important points, if you have it written down in front of you.
It also gives you something solid to present to the court.
When you can hand a judge your well written and well thought out response, he knows you have put real time into your own defense.
  Copies can then be made available as needed to others involved as well.
It also helps you to be non-emotional.
Your ex-wife may be flying off the handle with all kinds of accusations and charges, but you do not have to get caught up in them if you have a plan outlined on paper in front of you.
She will be less likely to draw your attention off of what is important this way as well.
And of course, any type of plan you have for repayment and the future will look much more thought out if you have it in writing.
So make your argument, make your payments and get it put it writing.
