There are various categories of property like intellectual property, real estate, goods and professional services among others. Real estate is the category that deals with immovable property. The immovable property consists of fixtures attached to the ground, the piece of earth that the fixture is standing on, the air above it up to a certain height and below up to a certain depth, crops on the land and the natural resources on that piece of land like minerals and water.

There are several different categories of land which are governed by different laws such as protected zones, communal lands, family land under trusteeship, company real estate, subdivision of land and the usage of land in areas like agricultural zones.

Unlike other property that can be sold under regular contract laws, real estate cannot be transferred under the same and or over the counter. Real estate is also a sensitive part of property. With time, the laws governing the real estate industry have developed thier own rules and regulations that govern the conveyance transaction. The conveyance transactio is the sale and acquisition of real estate.

Aspects that are governed by real estate law include foreclosures, mortgages, rents and leases. These are tasks that only qualified attorneys can carry out due to the cautiousness that is necessary.  Documents that are necessary in real estate transactions include the purchase agreement, trust documents of the property held under trust, the title deeds and the sale agreement between the parties.

 A Real estate attorney will assist with the drawing up of legal documents, inspection of the legal documents, stamping and attesting of the same as well as serving any documents that need to be served. The attorney is responsible for ensuring that there are no errors in the transaction and that the same goes on smoothly and in some instances, the attorney will need to have the power of attorney to act on behalf of a client.

Real estate attorneys can also help with negotiations and conditions to be applied or fulfilled in the event of a transfer. One major advantage of using an attorney is that it is much safer to carry out the transactions when both parties are represented by registered attorneys, especially when the buyer and seller are not acquainted. The attorneys protect the interests of both parties by reading the fine print in the documents before the transaction thereby preventing any scams or swindling.
