New York State's Health Insurance Law
- New York State requires all health insurance policies have a guaranteed renewability clause. When your policy expires, you are guaranteed the option to renew it if you wish.
- Insurance companies sometimes include clauses which exclude pre-existing medical conditions from coverage. New York State provides some protection by requiring that insurance companies can only exclude your condition for a maximum period of 12 months. In addition, if you switch from one policy to another, the time you were on the other policy counts toward the time on the new policy.
- Some insurance companies completely exclude some conditions from coverage. In New York, this is not allowed, so all conditions are covered by your New York health insurance plan.
Newborns and adopted children are automatically covered for a minimum of 30 days after birth or adoption by their parents insurance policy in New York State.
