How to Reverse a Legal Separation in Washington

    • 1). Obtain from the clerk of the court or from the Washington State Courts website a standard or sample form for a motion to terminate (see Resources for form).

    • 2). Complete the motion to terminate legal separation.

    • 3). State the reason why you desire to terminate the legal separation on the form.

    • 4). Note in the motion whether or not your spouse agrees with the proposed reversal or termination. Under Washington law, the court is not obliged to reverse or terminate a legal separation if both parties do not agree. In most cases, the legal separation remains in effect in such a situation.

    • 5). Sign the motion to terminate legal separation. Have your spouse sign the document if he agrees with the proposed termination.

    • 6). File the motion to terminate with the clerk of the court where your legal separation case was filed.

    • 7). Obtain a hearing date on the motion from the court clerk or the judge's administrative assistant.

    • 8). Notify your spouse of the hearing date and time. Washington state law requires notification to all parties.

    • 9). Appear at the hearing and present your position (and that of your spouse if in agreement) in regard to the reversal or dismissal of the motion to terminate legal separation.
