Michigan Family Law on Established Custodial Environment with Grandparents
- Michigan Code Section 722.27 defines an "established custodial environment" under state law. The court looks at the child's relationship with a custodian and considers whether the child looks to the custodian for "guidance, discipline, the necessities of life, and parental comfort." Either an informal or formal court-ordered custody arrangement may qualify as an established custodial environment.
- Michigan recognizes a variety of child-custody arrangements. A party without custody may be able to obtain visitation, also known as parenting time. Under Michigan law, grandparents can request parenting time if they can show an established custodial environment for the child during the year before the date of their legal action.
- Michigan Code Section 722.27b allows grandparents to ask for parenting time with a grandchild by submitting a motion to the appropriate court. The grandparents must file their motion with the circuit court with jurisdiction over legal issues related to the child or with the circuit court in the child's county of residence.
