    • 1). Select a name for your business. You can use your own name, such a "John Smith's Hardware," or you can invent a name, such as "Handy Hardware."

    • 2). Check the availability of your business name. If you use an invented name, or if you plan for your business to operate as a corporation or a limited liability company (LLC), you will need to determine if your business name is available for use. You can do this by checking the Arizona Secretary of State's business name database. You should also check both state and federal trademark registries for your chosen name. You will not be able to use that name if the same or similar name shows up in your business name search.

    • 3). Register your business name with the state. You must file articles of incorporation or organization with the Secretary of State if you plan on forming a corporation, LLC or limited partnership. Registration will prohibit others from using your name, though there is no requirement to register your name if you plan on forming a sole proprietorship or general partnership.

    • 4). Obtain the appropriate local licenses. Although there is no specific license requirement to operate a business in Phoenix, certain types of regulated businesses, such as street vendors, must obtain a license. Alternatively, if you are subject to certain taxes, such as a sales tax, you will be required to obtain a business license. Moreover, you will also have to obtain a federal employee identification number (EID) from the IRS if you plan on employing anyone.

    • 5). Obtain the appropriate permits. Depending on your specific business, you may need to obtain certain permits, such as a zoning permit or building permit, before you can operate within the city.
