How to Cancel Easements in Bankruptcy
- 1). File for bankruptcy. If you file for Chapter 7 bankruptcy, you may have to sell your land to repay your debts. In addition, the bankruptcy trustee has only 60 days to decide whether to void the easement or continue carrying it out.
- 2). File for Chapter 13 bankruptcy if you do not qualify for Chapter 7 bankruptcy. Under Chapter 13 bankruptcy, your trustee has until the date your structured repayment plan is approved to decide to void the easement or continue to carry it out.
- 3). Wait to get your notice in the mail about the first meeting of creditors. Send information about the easement to your trustee along with your other financial records so he can make a decision about it.
- 4). Attend the first meeting with creditors. Answer questions about the easement in addition to other questions your trustee asks.
- 5). Receive a notice of discharge of debts in the mail if you filed Chapter 7 or a notice of approval of your plan if you filed Chapter 13. Contact your trustee once you get the notice to find out whether he voided the easement.
