- Whenever someone causes an auto accident, their insurance policy covers the damages sustained by the innocent party. There are various types of auto insurance. Bodily injury liability insurance covers the costs of damages done to the person injured, while property damage liability insurance covers damage done to someone's vehicle or property. Collision coverage insurance covers the cost for damages done to your car as the result of an accident.
- Before anyone can be compensated from an auto accident, they have to prove the other party was negligent, or at fault. In some cases, this is easy. For example, if someone runs a red light and hits a car, the light-runner is clearly at fault. In other cases, when both cars have broken a rule of the road that results in a crash, both parties may be held liable.
- Drivers involved in an accident with an uninsured or underinsured driver may still receive compensation for their injuries if they purchase uninsured motorist coverage. Although some states require drivers to purchase uninsured motorist coverage, the majority of states do not. If a person settles with an uninsured driver privately, she cannot file another claim with her insurance provider.
