How to Write a Prima Facie Race Discrimination
- 1). State in the brief that you are a member of a racial minority group. This satisfies the first requirement of the four-prong test to establish prima facie evidence.
- 2). Prove that you applied for the job in question. As evidence, you can submit copies of application forms, correspondence relating to job interviews, etc.
- 3). Prove that you were qualified for the job. The subjective nature of "qualified" will be reviewed by the courts, but cite evidence showing that you can handle the necessary responsibilities, such as a resume citing past experience, copies of awards and accolades, educational degrees, etc.
- 4). State that you were rejected for the position. This fact will essentially be uncontested, but it's necessary to explicitly write it in the brief in order to meet the requirements under Title VII.
- 5). Show that the allegedly discriminatory employer continued seeking applicants after you were rejected, despite your qualifications.
