Oklahoma Marriage & Divorce Statutes
- Applicants for a marriage license in Oklahoma are required to show their driver's license, birth certificate or a passport as proof of age. Applicants who are 16 or 17 years old must have parental consent in order to marry. If both applicants complete a premarital counseling course, the fee for a marriage license is $5. Without a certificate from a premarital counseling course, the fee is $50.
- In Oklahoma, you can obtain a no-fault divorce on the grounds of incompatibility. You can receive a divorce under fault grounds if there is evidence of abandonment for at least 1 year, impotency, adultery, a fraudulent contract or imprisonment.
- In the case of a divorce when the couple has minor children, the court can appoint a guardian ad litem to represent the children. The guardian ad litem makes decisions about the proceedings based on the best interest of the children.
