What Paperwork Do You Submit for a Chapter 13 Bankruptcy?
- The bankruptcy petition is the primary form submitted, which includes all basic information about the petitioner and the type of bankruptcy being filed.
- Debtors must complete several forms, called schedules, outlining all of the individual's income, expenditures, property, contracts and leases, creditors and co-debtors.
- If filing for Chapter 13 bankruptcy, a five-year debt-repayment plan must be submitted either with the petition or within two weeks of filing the petition.
- Due to recent legislation, all bankruptcy petitioners must submit a certificate of completion of pre-bankruptcy counseling from a U.S. Trustee Program-approved organization.
- Debtors must also fill out the Statement of Financial Affairs form, which contains 25 questions regarding the debtors financial situation.
