The Transfer of Property With the Bare Act
- The act allows for the transfer of movable and immovable property, excluding the transfer of public office, military stipends and the right to sue. It specifies that a conditional transfer, in which property is reassigned based on the fulfillment of a condition, is permitted only if the condition is possible and lawful.
- Immovable property worth INR100 or more can only be transferred by a registered instrument or legal document. If the property is worth less than INR100, it can be delivered without this instrument.
- When making a gift of immovable property, the donor must sign a registered instrument in the presence of two or more witnesses. A gift of property can be revoked in the same way a contract between the parties could be overturned.
