It is a sad fact of life that as many as one third of marriages will end in divorce in the UK.
This is one of the most stressful experiences a person can go through in their life and it is a time when support is upper most in people's minds.
What do you need to produce when visiting a marriage lawyer? You should take along your marriage certificate, proof of residence, birth certificates of any children.
Also not the full names and addresses of those involved and any named third parties in cases of adultery.
The family solicitor you appoint will then get you to fill out a divorce petition, and send out copies to your spouse, any third party and the courts.
At this point you will receive a Notice of Issue of Petition, which will indicate your case number and acts as receipt for any payments made.
The court then forwards your spouse notice of service and they have eight days to respond, longer if they reside outside England or Wales.
Here the respondent will either ignore the letter, contest it or agree and make their own proposals.
If they don't reply within eight days you should issue the courts with a photo, description and address of the other party concerned and the court bailiff will personally serve the documents.
Once contacted they will then inform your family solicitors with an acknowledgement of service, as to their defence, whether they intend contesting the divorce and arrangement regarding property and children etc.
The other party must then issue their intent to defend the case and provide you with an answer.
If all the paperwork has been received and correctly completed then the judge will issue a date and time for the pronouncement of the Decree Nisi.
Six weeks after the Decree Nisi has been issued you can apply for the Decree Absolute and providing there are no other prohibiting reasons then it will under normal circumstances be granted.
