Bankruptcy & Payment History
- A bankruptcy eliminates the debt included in the bankruptcy. The debtor is no longer responsible for the debt, but the discharge will show up on the debtor's credit report.
- A discharge will not eliminate a debtor's pre-bankruptcy payment history from their credit report. A discharge will result in a notation on the debtor's credit report of the account's discharge in a Chapter 7 bankruptcy or of the inclusion of the account in a Chapter 13 wage-earner plan.
- On a credit report, the amount owed on a discharged account will appear as zero but the history of late payments will remain on the report for as long as allowed by law. A bankruptcy can remain on a debtor's credit report for up to 10 years from the bankruptcy filing date.
