Handling a Loved One"s Personal Injury Case

If someone you love has suffered from a personal injury, they may not be in a capacity to handle to handle their own case themselves.
They will need someone to represent them throughout the process of filing.
While a personal injury lawyer can do many things on behalf of the injured person, a person who is severely injured or traumatized may not be fit to engage in conversation, even with his or her own attorney.
In addition, someone who may be feeling weak and vulnerable may wish only to communicate with a family member, or someone that they love and trust.
The responsibilities of filing for a claim may then fall to you; it will be your job to interact and communicate with a personal injury lawyer on your loved one's behalf.
Here are a few things to remember when acting in this position: Be patient.
Your loved one may not be able to give as much strength to the case as you; remember, they have their own personal battle with their injuries to deal with.
Try to understand if sometimes they do not wish to discuss the case, or are difficult to work with.
They have undergone a traumatic experience and are only human.
Work with them at their own pace, and never force them to do something they do not wish to do, or push them too hard.
Write down as much of the victim's personal account as possible.
Sometimes, victims of an accident who have been severely traumatized may not be able to recall the events, or may refuse to give an account of the accident.
However, they may be able to narrate the event during certain bursts of clarity.
It is important that you document their account, verbatim if possible.
It may help to have a tape recorder and notebook on hand at all times, to make sure that when the moment comes, you will be ready.
Never lose sight of what you are fighting for.
Sometimes people in your position, fighting on behalf of a loved one, can forget that the main reason for their action is to help their loved one.
Throwing money, figures and percentages around, sometimes a case can begin to revolve around money instead of around the victim.
While money will certainly help ease the pain of a suffering victim, it is important to remember that money cannot change what has already happened.
You are fighting for your loved one, and not for money.
Protect your loved one.
Sometimes the insurance company of the liable party may try to exploit the vulnerability of the victim, by pressuring them into accepting a settlement.
While you should take the feelings of the victim into consideration, make sure that they are not able to low-ball the claim by exploiting your loved one's state of weakness.
Shield your loved one from direct contact with the liable part and their legal representation whenever possible, and ask instead that they communicate with you or your lawyer.
