Some states in the U.S. have helmet laws while some do not require motorcyclists or bicyclists to wear helmets. For example, the state of Kansas does not require people riding or driving a motorcycle or bicycle to wear a helmet. In the state of Florida, laws require the use of helmets in most situations. - According to Florida helmet laws, in order to legally ride a motorcycle without a helmet the person must be at least 21 and have $10,000 in medical coverage insurance.
- In all other cases where the driver of a motorcycle does not have $10,000 in medical coverage or is under the age of 21, the helmet must comply with federal motorcycle vehicle safety standards. Riders must have protective eye wear as well.
- According to ABATE, Florida's website, police in Florida have stated they will not pull someone over simply because a driver is not wearing a helmet. Only in the case where the bike rider's age is in question will Florida police pull over a biker for a helmet-only related violation.
- A bicycle rider age 16 or younger must be wearing a helmet at all times when operating a bicycle. The helmet must be properly fastened and meet all requirements of the American National Standards Institute.
- There is a list of approved helmets listed on the Florida Legislature website.
