How to File in Small Claims Court in Pennsylvania

    • 1). Go to a Pennsylvania court in the county where the defendant lives and and speak to a clerk about filing a small claims lawsuit. The clerk will provide you a Statement of Claims to fill out

    • 2). Fill out the Statement of Claims and attach any and all paperwork associated with the complaint to the Statement. File the statement with the clerk and allow them to determine what the fee will be for the lawsuit. This fee will be added to the judgment amount. You will need to have the correct spelling of the defendant's name.

    • 3). Serve the defendant with the papers regarding the lawsuit. The court will not do this for you. You must either send the summons via registered mail, send it with a sheriff, or use a court-approved non-interested third party.
