How to Remove a Father From the Birth Record

    • 1). Locate and contact an attorney through a lawyer-locating website, or consult your local or state's Bar Association for a lawyer referral. Inquire about the correct procedures for filing a petition in the court system to remove a father's name from a birth certificate. Most Department of Vital Records offices will not process a birth certificate amendment request without a court order clearly affirming its agreement with deleting the father's name from the birth certificate.

    • 2). Obtain a court order. Contact your respective county's clerk of court and inquire about which documents must be completed to remove the name from the birth certificate. You can complete this process independently or with the assistance of an attorney.

    • 3). Log onto your respective state or county's Department of Public Health website. The Office of Vital Records is generally housed in these locations. Look for "Vital Records" and "Birth Certificates" headings. Locate the "Forms" section of the website and click the links to download the application. Download, print and complete the form in its entirety. State your reason for the change on the application.

    • 4). Mail the application, a copy of both the court order and valid photo ID, if applicable, and a check or money order to cover any fees to the address listed on the form or website. Some agencies also require you to send a self-addressed stamped envelope, so the new birth certificate can be mailed back to you. You can also opt to visit your local Office of Vital Records to fulfill your request in person.
