How to make a small claim
- 1). Ensure you are eligible to bring a small claim in the county court. This requires that the value of your claim be at most £5000 (£3000 in Scotland), that the person or organization against whom the claim is brought be someone you can bring a small claim against (i.e. you cannot bring a claim against the Crown via the Money Claim Online website) and that you are within the time limit for bringing a claim.
- 2). Download form N1 (the CPR Part 7 claim form) from the HM Courts Service website. Complete the form by providing details about both the claimant (you) and the defendant (the person you are suing), a brief summary of the claim and the amount you are asking for. Sign the declaration.
- 3). Take the form to your local county court for processing. You will be required to pay an administration fee, which can vary based on the size of your claim. Photocopy the form so you have one copy for yourself, each defendant and the court.
