Definition of Affidavit of Domicile
- The representative of the deceased person's estate is typically the person who signs the affidavit of domicile. The representative, appointed by a probate court, must have the affidavit witnessed and notarized as a legal document.
- Affidavits of domicile may be used in a variety of situations. Most commonly, they are used to establish residency of a deceased person before transferring personal, residential or commercial property. They also may be used by banks or other asset holders to ensure legal transfer of assets other than property, such as stocks, bonds and other financial assets, to a third party.
