How to Collect a Judgment Against the California Highway Patrol

    • 1). Begin the declaration with the following language: "I, (your name), herein declare the following:"

    • 2). Declare that you have a judgment against the California Highway Patrol.

    • 3). Include the name of the court case, the county where the case was decided and the case number. For example, "This judgment arose in Smith v. California Highway Patrol, county of San Diego, case number 1234567890."

    • 4). Demand payment for the judgment amount.

    • 5). Conclude the declaration with language that the declaration is made under penalty of perjury and that everything included in the declaration is true to the best of your knowledge.

    • 6). Date and sign your name at the bottom of the declaration.

    • 7). Acquire a certified copy of the judgment from the court clerk, as well as a Proof of Service form. Also confirm with the clerk that the court has your current mailing address.

    • 8). Make two photocopies of the declaration and the judgment. One copy of each will be mailed, and the remaining copies are for your records.

    • 9). Deliver one copy of the declaration and the certified judgment to a Highway Patrol office.

      Direct any willing person at least 18 years old to mail a copy of the declaration, the judgment and a completed Proof of Service form to the California Highway Patrol office.
